Terms of Service
Bites (“Bites”, “we”) is an app that food shops can use to run their business. These terms apply to every business that uses it (“you”, “your shop”). By using Bites you agree to these terms and accept that you use it at your own risk. Your own customers ordering from your shop are covered by your shop’s ordering terms and privacy notice, not these terms.
1. What Bites is
Bites is software for running a food business: a website and online ordering, a counter (till), a kitchen screen, self-order kiosks, menu boards, a loyalty card (Bites Club), reports and stock. Parts of it run on a computer in your shop (“Bites Store”) and parts run on our servers (“Bites Cloud”).
2. Use at your own risk
Bites is provided “as is” and “as available”, without warranties of any kind, express or implied, including that it will be accurate, uninterrupted, secure, error-free, or fit for your purpose. You decide whether Bites suits your business, and you remain responsible for:
- Checking orders, prices, sales tax, totals and reports before you rely on them.
- Keeping your own records and backups, and a way to keep serving customers (for example pen and paper) if Bites, your computer or the internet stops working.
- Your equipment: the computers, tablets, printers and network in your shop.
3. Your account
- You are responsible for the accounts in your business (owner, cashiers, kitchen, kiosks) and for what is done with them.
- Keep passwords private, give each person their own account, and remove accounts for people who leave.
- Tell us straight away if you think an account has been misused.
4. Your responsibilities as a shop
- Your menu, prices, taxes, opening hours, photos and descriptions are yours: keep them accurate and lawful.
- Food safety, allergen information, licences and permits for your business remain your responsibility.
- You decide what happens with orders, refunds and complaints from your customers.
- You are responsible for your customers' personal information that you collect through Bites. We handle it only on your behalf (see our Privacy Policy) and you must use it lawfully, including when a customer asks you to delete it (Owner → Customers → Bites Club → Delete a customer’s details).
- Use your own website address only if you have the right to it.
5. Acceptable use
You must not use Bites to break the law, to send spam, to collect data you are not allowed to collect, to try to get into other businesses’ data or our systems, to overload or disrupt the service, or to copy or resell Bites without our written permission.
6. Fees
Fees, if any, are agreed with you separately in writing. If agreed fees are not paid, we may suspend online ordering and access to Bites Cloud after telling you; the software in your shop keeps your data.
7. Your data
- Your business data (menu, orders, sales, stock, staff and customer records) belongs to you.
- We use it to provide Bites to you, to keep it secure, and as the law requires.
- We also use it to improve Bites for all shops, for example usage and error statistics, what sells and when, and how features are used. We do this with combined or de-identified data wherever we can, and we never sell your data or use it for advertising.
- You can ask us for a copy of your data, and for it to be deleted from Bites Cloud when you stop using Bites. The copy on your shop computer is yours to keep or delete.
8. Availability and changes to Bites
Bites may be unavailable at times, and it may change. The counter, kitchen and kiosks are built to keep working in your shop when the internet is down; online ordering pauses until the connection is back. We may add, change or remove features, or stop offering Bites, and will try to give notice where we reasonably can.
9. Stopping
You can stop using Bites at any time. We may suspend or end your access if you break these terms, or if we stop offering Bites; where we reasonably can, we’ll give notice and a chance to take a copy of your data.
10. No liability
To the fullest extent the law allows, we are not liable for any loss or damage arising from your use of Bites or from not being able to use it, including lost sales or profits, wasted food, lost or incorrect data, wrong orders, prices or taxes, fines, or claims by your customers. If the law does not allow this to be excluded, our total liability is limited to what you paid for Bites in the 12 months before the claim.
You agree to cover any claim made against us by your customers or others that arises from your shop, your food, your menu or your use of Bites.
11. Changes and law
We may update these terms; we’ll show the new date above and tell you about important changes before they apply. These terms are governed by the laws of the State of Connecticut, USA. Questions: bites-cloud.com.
